  2. In 2020, as a “goodwill gesture” (clause 7.6.6. Force Majeure), we refunded all guests in full, without processing fees, as no one could have foreseen such a pandemic.
  3. Following the declaration of COVID-19 as a global pandemic by the World Health Organisation, the extenuating circumstances rule no longer applies,
  4. because COVID-19 and its consequences are no longer unforeseen or unexpected.
  5. Should a similar situation as in 2020 of a Covid-19 pandemic occur,  the property owner might consider to offer a credit for the booked house.
  6. Sanitary measures imposed by the Mauritius Tourism Authority are publised on our web site and communicated to our guests. They are meant to be followed by owners and travellers.
  7. Terms & Conditions
  8. 1 – Agreement between Client and BeachHousesMauritius
  9. BeachHousesMauritius is provided to you for the purpose of searching, selecting and
  10. making a reservation for a property rental listed in our portfolio.
  11. 1.1. This web site and our booking service is made available to you conditioned upon
  12. your acceptance of the terms set forth below.
  13. By accessing or using the BeachHousesMauritius web site and by renting a property
  14. with us, you agree to be bound by these Terms and Conditions. These Terms and
  15. Conditions apply equally to the Group Leader and to all the persons named in the
  16. Booking Confirmation (Client or Occupant)
  17. 1.2. Terms and Conditions are instructed to BeachHousesMauritius by the property
  18. owner – in short “owner”.

  21. 2 – BeachHousesMauritius Service
  22. 2.1. BeachHousesMauritius provides a web site and a service to book property rentals
  23. in the selected destinations offered on the web site.
  24. 2.2. You are fully responsible for the purchase and the organization of your
  25. transportation to the rental property (We will help to arrange with a local service
  26. provider).
  27. 2.3. You are also fully responsible to check and comply with local regulations regarding
  28. passport and visas as well as health requirements. Please contact your local office for
  29. foreign travel and passports to enquire about passport, visa and health requirements
  30. for the country in which the property is situated.

  32. 2.4. It is a condition of booking that you take out adequate travel insurance.
  33. As a minimum this should include cover for third party liability, vacation rental and
  34. medical repatriation. Your Booking Confirmation will be treated as confirmation that
  35. every member of your party has such insurance.
  36. 3 – Bookings
  37. 3.1. You can book once availability and rate have been confirmed to us by the owner
  38. and the Invoice has been issued to you.
  39. 3.2. We will confirm your reservation upon payment of the Booking Deposit.
  40. Payment of your booking deposit is your confirmation that you have read and agreed
  41. to the Terms and Conditions of rental.
  42. 3.2.1. Changes to Confirmed Bookings
  43. Minor changes to your confirmed booking dates are possible, based on availability.
  44. Based on seasonal rates, a surcharge may or may not be applicable for date
  45. changes.
  46. Confirmed bookings are not transferable to another person and it is for the exclusive
  47. use of clients shown on the Booking Confirmation.
  48. 3.2.2. Arrival / Departures
  49. Check In: from 2pm Check Out: latest 10am
  50. Should you want to secure an early check in or late check out, a supplement of 50% of
  51. the nightly rate might be applicable after prior approval from the owner.
  52. 4 – Security Deposit
  53. 4.1. When you book with us, you accept responsibility for any damage or loss (Damage)
  54. to the property or adjacent properties caused by you or any member of your party,
  55. any external service provider or visitors to the property.
  56. Full payment for any such Damage must be paid at the time direct to the owner or his
  57. local representative.
  58. 4.2. Owners require a security deposit to cover them against Damage (including
  59. excessive cleaning, lost and broken items etc) . We recommend that you ensure that
  60. your insurance policy covers accidental damage to the property and its contents. Your
  61. security deposit shall be returned to you at the end of the booking period, after
  62. deduction of the cost of any damage.
  63. 5 – Payments
  64. 5.1. Full payment of the balance as shown on your Booking Confirmation is a few weeks
  65. prior to your arrival.
  66. 5.2. If the payment is not received at the point stated in the Booking Confirmation, the
  67. owner reserves the right to cancel your booking and levy cancellation charges as
  68. detailed in the Cancellation Conditions (6.).
  69. 5.2.1.Booking Deposit:
  70. A non-refundable deposit of 30% of the total, is required within 7 days of your
  71. booking. Your booking will be confirmed at the time that this deposit is received.
  72. 5.2. Final Payment:
  73. Balance payments will be required 45 days prior to arrival and are non refundable.
  74. Should a payment be late by 48 hours after written reminder, the owner reserves the
  75. right to cancel your booking.
  76. 5.3. Method of Payment:
  77. All payments shall be made by bank transfer and must be Invoice exact. Please make
  78. sure that all bank charges associated with the transfer will be at the remitters cost. Indication of charge: “OUR” transfer: All fees will be charged to theremitter.
  79. Any open balance will need to be settled with the final payment or upon arrival
  80. 6 – Cancellation
  81. 6.1. Should you need to cancel your booking after confirmation, you must immediately
  82. advise us in writing toxyz-trading.odoo.com/contactus
  83. 6.2. Your notice of cancellation will only be effective when it is received in writing by us.
  84. 6.3. In the event of cancellation your Booking Deposit and/or Final Payment are non-refundable.
  85. (If we can replace your reservation the owner will consider refunding part of
  86. your payments)
  87. 6.4. Although it is unlikely that we will have to make any changes to confirmed
  88. arrangements, it could occasionally happen, and we will advise you at the earliest
  89. possible date. If for any reason beyond our control we are unable to provide you with
  90. the property you have booked, we reserve the right to transfer to a similar or better
  91. property. However, if this is not possible or you do not wish to be transferred, we will
  92. cancel the booking and refund the amount paid to us for the property but we will not
  93. be liable for any cancellation charges for travel arrangements.
  94. 7 – Villa Description and Liability
  95. 7.1. The photos on BeachHousesMauritius website are intended to give a general
  96. overall impression of the standard of the villas we offer. Some aspects of the property
  97. may have changed by the time you come to make your booking, for example, items of
  98. furniture may have been removed/exchanged by the owner. We cannot accept any
  99. liability if this situation should arise.
  100. 7.2. We make sure to use reasonable skill and care in making your booking and
  101. selecting the property owners we work with.
  102. 7.3. Neither the owner, owner’s representative nor BeachHousesMauritius are responsible
  103. concerning problems with external service providers such as water, electricity supply or
  104. telephone/internet network
  105. 7.4. BeachHousesMauritius has no responsibility for the properties themselves or for any
  106. services provided by property owners.
  107. 7.5. We act as an agent for the owner. Your contract for your accommodation is
  108. directly with the owner concerned.
  109. 7.6. The Owner, owner’s representative or BeachHousesMauritius shall not accept
  110. responsibility for losses to guests for any claims, including but not limited to:
  111. 7.6.1. Responsibility for personal accidents and body injuries (falls from pool
  112. decks, wet tiles and or stairs along with any sliding glass door injuries and falling
  113. “objects” as coconuts or when using kayaks, SUP’s, bicycle etc. ), death, lost, stolen or
  114. damaged property, loss of mental or physical enjoyment, delay or inconvenience
  115. 7.6.2. Any delays of changes in schedule, itineraries, incurred by any person
  116. arising out of any willful or negligent or omission of any carrier, airline, villa, ground
  117. operator or other person who does not render any services or accommodations.
  118. 7.6.3. The act or omissions of any party
  119. 7.6.4. Monetary crisis, labour problems, economic changes, mechanical
  120. maintenance or construction difficulties or noise, climatic aberrations, local laws or
  121. unexpected conditions;
  122. 7.6.5. Absence of travel documents, passports, visa and health certificates, where
  123. required.
  124. 7.6.6. Additional expenses due to delay or changes in air or other services,
  125. missed carrier connections, substitute accommodation or of common carrier equipment,
  126. termination of service, change in fare and rates, cancellation or double booking
  127. reservations or tickets, sickness, strike, war, quarantine, pilferage, monetary crisis, political
  128. or social unrest, disease, Force Majeure or any events beyond our control.
  129. 7.7. Therefore, each guest agrees he/she is voluntary participating in any and all
  130. activities, risks, and use of the accommodations, and hereby assumes all risk of injury,
  131. illness, damage or loss to person and property that might result, including, without
  132. limitation, any loss or theft or personal property.
  133. 8 – Pest Control / Tropical fauna
  134. 8.1. Regular pest control treatments against insects and prowlers are carried out during
  135. the year. Despite of the precautions taken, the presence of insects and prowlers on the
  136. premises cannot be completely avoided.
  137. 8.2. The owner will thus not be liable to compensate the client and his guests for any
  138. discomfort which could result from same.
  139. 9 – Behaviour
  140. 9.1. We expect all clients to have consideration for other people. Illegal or immoral
  141. activities including gambling, prostitution, prohibited drugs, possession or use of
  142. pyrotechnics or dangerous goods, and possession or use of firearms and other
  143. weapons are all strictly prohibited.
  144. 9.2. Please note that in Mauritius topless sun bathing can be considered as an offence.
  145. 9.3. If in our reasonable opinion or in the reasonable opinion of the owner or property
  146. representative, you or any member of your party behaves in such a way as to cause or
  147. be likely to cause danger, upset or distress to any third party or damage to property,
  148. we are entitled, without prior notice, to terminate the stay of the person(s) concerned.
  149. 9.4. The client is responsible for the behaviour of all the guests staying at the property.
  150. Should any guests not behave in a suitable manner, the owner, owner’s representative
  151. or BeachHousesMauritius may, in their absolute discretion, require the client or their
  152. party to leave the premises and/or vacate the property immediately, without
  153. compensation or refund.
  154. 9.5. Smoking is generally prohibited in the house.
  155. 9.6. The client shall not conduct any modification or transformation of any kind
  156. whatsoever to the villa or to the ancillary buildings.
  157. 10 – Occupancy
  158. The owner, owner’s representative of the property concerned reserve the right to
  159. terminate your stay without notice if the owner/owner’s representative discover that the
  160. number of persons staying at the property exceeds the number stated on your Booking
  161. Confirmation and you have not gained the owner’s prior written permission for this and/
  162. or paid any extra associated costs. In this situation, no refund will be made and we will
  163. have no further responsibility to you.
  164. 11 – Entry and Inspection
  165. 11.1. The owner, owner’s representative or BeachHousesMauritius reserve the right to
  166. enter the Property at reasonable times and with reasonable advance notice for the
  167. purposes of inspecting the Property and/or for small works and necessary repairs.
  168. 11.2. If the owner, owner’s representative or BeachHousesMauritius has a reasonable
  169. belief that there is imminent danger to any person or to the property, they may enter
  170. the property without advance notice.
  171. 12 – Events
  172. 12.1. All bookings are assumed to be for normal holiday purposes only, and the client
  173. agrees that the use of the property will be limited to this purpose unless otherwise
  174. confirmed in writing.
  175. 12.2. If you are planning to hold an event, such as a wedding or party, which involves
  176. having a larger number of people at the property, or if you are planning to use the
  177. property for a purpose other than holiday, please communicate this to
  178. BeachHousesMauritius at the time of booking, as special approval or arrangements are
  179. required.
  180. 12.3. Depending on the nature of the event, a surcharge and/or additional security
  181. deposit may be required, which will be agreed and confirmed in writing prior to
  182. confirming the reservation.
  183. 13 – Swimming pools and Wellness Areas
  184. 13.1. Swimming pools by their very nature carry their own inherent risks. You must ensure
  185. that you and all members of your party take great care when using or being near any
  186. swimming pool at the property where you are staying. You should for example make sure
  187. you and all members of your party are aware of the depth and layout of the pool prior
  188. to use and that all persons walk rather than run around or near the pool. Children must
  189. be supervised at all times by a responsible adult.
  190. 13.2. At all times, you and your guests are to consider your own safety and the safety
  191. of others when using the wellness area. Use of the wellness area is at your and your
  192. guests own risk.
  193. 13.3. Facilities are to be used for the designed purpose and in compliance with the
  194. instructions given by the staff of the property or the owner. Without prejudice to the
  195. generality of the above, the following things are strictly prohibited in the wellness
  196. areas :
  197. – running;
  198. – diving or jumping into the swimming pool or Jacuzzi;
  199. – drinking of any alcohol or using the wellness area when under the influence of alcohol
  200. or drugs;
  201. – leaving children unsupervised in the wellness area.
  202. 13.4. The direct, visual and active supervision of children present in a wellness area or
  203. by a swimming pool by an adult is essential and under your sole responsibility.
  204. 13.5. The swimming pool, Jacuzzi etc located in the property do not comprise an alarm
  205. system, safety net or other safety measures designed to prevent the risk of drowning. To
  206. ensure the safety of children, the following precautions must be taken, in particular:
  207. – never leave young children alone near the swimming pool or Jacuzzi;
  208. – never leave a child alone in the water, even if they know to swim, or in a Hamman,
  209. steam room, sauna etc. They must always be under the supervision of an adult capable
  210. of saving them in the event of an accident;
  211. – never leave toys or other items floating on the water; they may encourage children to
  212. approach the water; and
  213. – always fit inflatable armbands of floating costumes on young children.
  214. 13.6. If you fail to comply with the rules and security precautions set out in these
  215. Conditions, the staff of the property or the owner, owner’s representative shall be
  216. entitled to prohibit the use of the wellness area or the swimming pool for the duration of
  217. your stay.
  218. 14 – Animals
  219. No animals are allowed in the properties – please do not feed stray animals and do
  220. not let them in the house.
  221. 15 – Guest Reviews
  222. BeachHousesMauritius is allowing clients to post reviews of their stay in a property. We
  223. may collect and display reviews, comments and other material from guests after they
  224. have completed their rental period purchased via BeachHousesMauritius.
  225. You disclaim any proprietary rights you may have in such guest review, and your review
  226. (s) may be freely used, copied, distributed and made available in any medium and in
  227. any form by BeachHousesMauritius or its affiliates without your permission.
  228. Specifically, by using the BeachHousesMauritius guest review feature, you represent and
  229. warrant that:
  230. – you control all of the rights to the guest reviews that you post;
  231. – as at the date of posting, the guest reviews submitted are accurate;
  232. – you will not intentionally or recklessly post information that could cause injury or
  233. offend any person;
  234. – you will not post any comments, information or material that is untrue; malicious;
  235. defamatory; abusive; obscene or could reasonably be taken as such; you will not act
  236. in any way to deceive or mislead and will not engage in or encourage any fraudulent
  237. or illegal activity.
  238. BeachHousesMauritius does not verify, endorse or approve the views or comments
  239. expressed in any reviews which are the personal views of the individuals submitting
  240. them. Any decisions made on the basis of reviews or comments appearing on the
  241. service are taken at your own risk.
  242. BeachHousesMauritius reserves the right for any reason in its sole discretion to refuse to
  243. post or remove (without notice) any reviews – this includes situations where
  244. BeachHousesMauritius receives a third party complaint and/or has reason to believe
  245. that there has been a breach of these terms and conditions
